By booking, accessing, or using any property offered through Utah Pickleball Retreats (“Company”), you agree to the following legally binding terms.
1. Booking Agreement
All reservations are subject to availability and confirmation.
Completion of a booking constitutes acceptance of these Terms.
2. Permitted Use
Guests agree to:
- Use the property responsibly
- Follow all house rules
- Comply with local laws and regulations
Unauthorized events, excessive occupancy, or misuse may result in immediate termination without refund.
3. Assumption of Risk (CRITICAL)
Guests acknowledge that use of the property and all amenities is at their own risk, including but not limited to:
- Pickleball courts (including competitive and recreational play)
- Sports courts and equipment
- Outdoor areas, landscaping, and uneven terrain
- Pools, hot tubs, or recreational features (if applicable)
Participation in physical activities carries inherent risks, including injury, disability, or death.
4. Release of Liability
To the fullest extent permitted under Utah law, guests agree to release and hold harmless:
- Utah Pickleball Retreats
- Property owners
- Hosts and co-hosts
- Property managers
- Employees, contractors, and affiliates
from any claims, injuries, damages, losses, or liabilities arising from:
- Use of the property
- Participation in any activity
- Accidents, incidents, or negligence
5. Indemnification
Guests agree to indemnify and defend the Company against any claims resulting from:
- Guest actions or negligence
- Damage to property
- Violations of laws or rules
6. Booking at Your Own Risk
Guests acknowledge they are voluntarily booking and assume all risks related to:
- Travel disruptions
- Weather conditions
- Property use
- Group activities
7. Property Condition & Amenities
We strive to maintain all amenities but do not guarantee:
- Continuous availability
- Uninterrupted utilities or services
No refunds will be issued for minor disruptions.
8. Security & Surveillance
Exterior cameras may be in use.
No cameras are located inside living areas.
9. Force Majeure
We are not liable for disruptions caused by:
- Weather or natural disasters
- Government actions
- Utility outages
10. Payments & Charges
Guests agree to all charges including:
- Rental fees
- Taxes
- Security deposits
- Damage or cleaning fees
11. Governing Law
These Terms are governed by the laws of the State of Utah.
12. Acceptance
By booking or accessing the property, you agree to these Terms & Conditions.
