TERMS & CONDITIONS

Effective Date: March 22, 2026

By booking, accessing, or using any property or service offered through Pickleball Retreats USA (“Company,” “we,” “us,” or “our”), you enter into a legally binding agreement. Completion of a reservation, payment, or entry onto the property constitutes full acceptance of these terms.

1. THE BOOKING AGREEMENT

All reservations are subject to availability and written confirmation. A booking is not considered “confirmed” until the initial payment is processed and any required guest verification is completed.

2. PERMITTED USE & CONDUCT

Guests agree to use the property exclusively for residential and recreational purposes.

Compliance: Guests must follow all house rules, local ordinances, and federal laws.
Termination: Unauthorized events, exceeding maximum occupancy, property misuse, or smoking/vaping inside the premises will result in immediate eviction without refund.

3. ASSUMPTION OF RISK (SPORTS & RECREATION)

Guests acknowledge that the use of specialized sports facilities involves inherent risks. By using the property, you voluntarily assume all risks associated with:

Pickleball & Sports Courts: Including competitive play, training, and equipment use.
Physical Activity: Risks include, but are not limited to, bodily injury, permanent disability, or death resulting from physical exertion or accidents.
Property Features: Use of pools, hot tubs, outdoor landscaping, and uneven terrain.

4. RELEASE OF LIABILITY

To the fullest extent permitted by law, the Guest hereby releases and holds harmless Pickleball Retreats USA, property owners, hosts, managers, and affiliates from any and all claims, damages, or liabilities arising from:

Accidents, injuries, or negligence occurring on or around the property.
Participation in any recreational activity or use of amenities.
Loss or theft of personal property.

5. INDEMNIFICATION

Guests agree to indemnify and defend the Company against any claims or financial losses (including legal fees) resulting from the Guest’s negligence, intentional property damage, or violation of these Terms or local laws.

6. PROPERTY CONDITIONS & AMENITIES

While we maintain high standards for our flagship Utah estate and all managed properties, we do not guarantee:

Uninterrupted utility services (Internet, HVAC, Water, Electricity).
100% uptime for all recreational features (e.g., specific court equipment or pool heaters).
No refunds will be issued for minor maintenance issues, weather-related disruptions, or utility outages beyond our control.

7. SECURITY & SURVEILLANCE

For the safety of our guests and the protection of the estate:

Exterior Surveillance: Exterior security cameras may be active.
Privacy: No cameras are located inside any interior living or private spaces.
Tampering: Disabling or obscuring security equipment is a violation of this agreement and may result in immediate termination of the stay.

8. FORCE MAJEURE

The Company is not liable for cancellations or disruptions caused by “Acts of God” or events beyond our reasonable control, including extreme weather, natural disasters, government restrictions, or infrastructure failures.

9. PAYMENTS & FINANCIAL OBLIGATIONS

Guests agree to pay all rental fees, taxes, cleaning fees, and security deposits. We reserve the right to charge the payment method on file for:

Documented damage to the property or equipment.
Excessive cleaning required post-departure.
Unauthorized late check-outs.

10. GOVERNING LAW

These Terms & Conditions are governed by the laws of the State of Utah. Any legal disputes arising from this agreement shall be settled in the appropriate courts of the State of Utah.
